So I did some intense searching and came up with nothing. So in my latest horror flick, the main character is driving home really late at night, and is drinking a beer. Now, as you know, that's illegal. How should I go about doing this?

Apple juice or non-alcoholic beer.

First of all alert your local police to what your doing. If you get pulled over and the driver has a beer bottle in his hand, it aint gonna look good. As for the beer just get an empty can or bottle, wash it out and put water it (unless the audience will see it, in that case use a juice of fizzy drink that is a simillar amber colour). The only reason you actually need to have a liquid is to add some weight and realism when your actor goes to take a drink.

Take some pepsi and water it down. It works and looks really good.

its not the liquid i'm worried about, its the can. i think i'm just going to use non-alcoholic beer like sonny said.

Since it's night, a glass Root Beer bottle might work out as well.
be careful - (some, perhaps all) non alcoholic beer contains a very low amount of alcohol. this is why it is still illegal to sell to minors. you can still be arrested for driving while drinking, even though you are not driving while intoxicated.

Like someone else stated, notify the police and take all of the precautions necessary. If they know where you are shooting and when, nothing should go wrong.

You could just go the Repo Man route and get a normal can of soda, then just glue a plain blank label that says "BEER" to the can.

They did this with all of the products in the movie, just blanked them out and put on plain labels that just stated what they are.

They did it just to avoid copyrights, but it came out having an artistic reverberation from it, because it added to the feeling of the movie, how everything was standardized and regulated.
Just an idea, you don't have to go with it, just thought I would share with you one of the more interesting ways to get around it.
You could also go the Tarantino or Kevin Smith route, of making FAKE brands for everything, like Big Kahuna Burger, and Apple Cigarettes, and later Nail Cigarettes in Clerks II.

Just use a can of root beer, and cover up the 'root' part with the actor's hand.
