You can only have one audio track, so it's either music or narration. Get around it by adding the music first, saving it into one video file, then importing it again and adding narration.

What are the laws and guidelines and requirements for using a bands song in your shortfilm?
elscottomagnifico
04-27-2008, 04:53 AM
If you don't have permission, you shouldn't be using it. This goes for personal/private use or public use (film festivals, profit ventures). You either have to license the music or find creative commons licensed music that allows for use in whatever situation you have(for profit or not is an example).

Really the best thing you can do is contact the artist and find out on what conditions they would be willing to let you use their music as the rules vary from artist to artist

What are the laws and guidelines and requirements for using a bands song in your shortfilm?
I have no formal legal training. This is a layman's understanding of copyright law as it applies to music. Nothing in this post should be taken as legal advice and, if in doubt, see a solicitor.
Long answer: There are several different forms of copyright, relating to the specific performance of the song, the distribution of the song and use of the song as written. Often, the record company will own all of rights, sometimes the rights will be afforded in some convoluted way. The first point of call would likely be contacting the record company, but I've never taken it to that level. Chances are, if it's a well-known song, it just ain't going to happen. Sometimes there will be provisions for low-budget films, but I don't think that's particularly widespread. Songs distributed under a Creative Commons license will allow unlimited redistribution and molestation, but you'll really need to be certain you're using Creative Commons music before you use it.
Short answer: Don't.

I would recommend stuff like light jazz and light dramatic music. Music in film noir doesn't have to be super intense and everyone likes a little saxophone.
Check out freeplaymusic.com (http://www.freeplaymusic.com) they have a lot of good music and it's free to use as long as it's not commercial.

What if I want permission to use a famous song in a movie?
Then expect to pay for it. And by pay I mean in the hundreds to thousands. You're going to need an entertainment lawyer or manager who is established within the industry to put you in contact with the people who own the rights to the music.
Here's the best part. Music liscences are in fact in two parts and each have a price tagged attached. The first licence is for the music itself. Meaning the arrangement of notes that make up the song. The next for the actual recording of the song (note, you obviously can't get this liscence without the first). If you get just the first licence however you can have someone else performing the song. To give you an idea for cost they had to pay $1600 for a few lines from a Yes song at the end of Sarah Silverman's Jesus is Magic.

Short answer: No.
Long answer: No ;)
You see a lot of the smaller independent film festivals will in fact allow you to use copywritten music but there's a bit of a catch. The unwritten rule is that you can't use any songs that are too famous but ones that are recognizable but not a chart topper.
The general rule of thumb is that if you have no plans to sell it or screen it and get paid then you're pretty much in the clear. Take Youtube as an example. The most viewed video of all time on there is FILLED with copywritten music that he doesn't have permission for.
However if you do plan to make any sort of money back you better get those liscences down or the man will be on your ass.

To make your movies more original, get in touch with either friends or family that can play musical instruments and make up your own theme tune / action or suspence music.
An alt. option is to use Royalty free music but that might not give you the sound that you are looking for
dailyproductions
05-02-2008, 11:24 AM
Please always remember to consult your entertainment lawyer if you have legal questions.
Legit film festivals will not allow films in without the proper clearances to begin with. If they do, they do so with the filmmaker taking full responsibility for legal action that may arise from using material that had not been through the proper clearances (i.e. if you have not acquired the music's Master Use License as well as Synchronization License... you can also usually negotiate a Festival Use License for less money if your film is only intended for film festivals. )
That is if it is a signed band.
If you have an unsigned band with original music then you can have a contract written up with the band that states the licensing of the music for this film is inclusive of any and all public performances as well as cleared for future distribution (possibly including use in trailer and/or web use) for $0 or some other fee.

05-02-2008, 06:33 PM
About the '30 second rule,' it's not true. It's a very common legal myth that seems to derive from a bizarre interpretation of the legal concept of 'fair use.'
Fair use is actually quite complicated, but the eligibility criteria basically boils down to this: 1. The nature of your work. 2. The nature of the work used. 3. The amount and substantiality of the work used. 4. The impact upon the profitability of the work used.
Suffice to say, there is no 'cut-and-dry' threshold under which you are safe from legal retribution. It's all arguable in court -- you will have to prove that you have satisfied the criteria of 'fair use.'
Here's a copy of the relevant code from Cornell University Law School (http://www.law.cornell.edu/uscode/17/107.html).
Note: I am not a solicitor. This does not constitute legal advice. If you need legal advice, visit a solicitor.

No, no, no, no! This is totally false. My above post gives a layman's definition of 'fair use' and links to the relevant section of the US copyright code. This post is completely misleading; there is no 'cut-and-dry' threshold for fair use.

I understand that there is a thread about free music in another forum but I was wondering if you guys knew about the kind of music that isn't really a song or even instrumental. Like for example: In a movie a guy will be asked about something from his past (that he thought no one knew) by a mysterious character. A cue of music will then play. It's like a serious low note that encites wonder or nervousness.
I hope someone knows what I'm talking about. It's pretty much music that isn't a song and can't be awkwardly faded out that creates a certain tone to a scene. It is similar to the dramatic and suspense accents from iMovie audio database. Anyone? But it has more applications and may not be as campy sounding.
I apologize if this has been posted. I realize that there are music threads. I just didn't know if it were to this particular type of music (if anyone gets it) and what to type in the search. It's hard to explain. Please help.

yeah, great idea! ^^ this way people can make their own music, easily, and as cheap as possible, plus, we can maybe get a collaboration project going, people who play drums, other people that do guitar, bass, can send sheet music or tabs for their instruments. After the drummer or bassist records their part, they can post the MP3 or whatever on the collaborative thread. Next, someone with some music making/mixing talent can go in and put it all together, and just like that, we have a song.

OK, you should get FL Studio. You can do all your composing in there, and then have your actors sing over that, and when you go to shoot your movie have your actors lip-sych over the final track.

fl studio is probably a good one to start on for pc. i know its very popular, but im a mac user and use Logic Pro so i couldnt give too much advice on FL.
i know you can get FL Express for 49 dollars as a download, or the next step up is 99 dollars.
heres some more information:
http://www.flstudio.com/documents/what.html
your other option is to compose the music handwritten (i cant think of any free computer scoring programs, anyone else got any ideas?) and then perhaps send the score to someone who can record the music and have them do it for you. But there you have the problem of your actors singing.

Log in and click on the Music tab, then click on Creative Commons. There is a break down of the Liberties on the right hand side. In your case, you are going to want to select music from the Attribution category.
One the left side you will see examples from each Liberty category. Just go to Attribution only and click More Albums and there you go.
These artists will allow you to download, share, and use their work as long as you give them credit. You could also get something from Non-Commercial but like the name implies only for Non-Commercial school or non-profit projects.
I would still send the artist a note on the use of their music, I'm sure they would like to know that something they created was enjoyed and being used. Plus, they might promote your project because your promoting them.

Depending on what you really need you can always buy the crappy sounds at party city or w/e, but here's the basic tip for using any music: Stay Instrumental, Max of 30 seconds, and Cite the song and artist in your credits.
I suggest listen to a lot of Pink Floyd an other bands as such. The music is not only awesome, but with a lot of mostly instruments, you can cut out enough of what you need for cool background music.
Another tip would be to mix different artists' instrumental pieces till it sounds like what you need. It's a lot more work, but you can do it with any basic program, even windows movie maker.
TreasureBox Films
10-12-2008, 02:50 PM
You are only infringing on copyrights if you make money off the movie.
Just making sure, you know instrumental music is illegal to use without permission too, right? You couldn't just cut out the singing from a song and put it in your movie.Yep, its still illegal. In most cases its the melody of a song that makes it unique. Instrumentals just have an instrument, as opposed to a voice, playing the melody. For example you can't copyright a chord change but if you stole the riff from a song you'd get sued.
Another tip would be to mix different artists' instrumental pieces till it sounds like what you need. It's a lot more work, but you can do it with any basic program, even windows movie maker. This is something that rap and r'n'b artists do. And the producer has to track every sample they used in the song and make sure they have paid to use it. Otherwise they get sued. There are so many cases where rappers, and even small time djs, used a sample of someone elses song without permission and then were sued. It's copyright infringement. It's illegal.
Not sure if it actually is legal to use it providing you aren't making a profit. You'd be safer keeping it completely out of public domain if you aren't sure.
In tv and radio it's actually often cheaper for them to pay to record a cover of the song. They then get a different band to record the song, but pay the original singer(if they can afford to, if not they pay someone who sounds like it) to sing on the track. It's actually cheaper to do it this way. But obviously it's not an option for most of us.
Rob
Oh and just so it's clear: when I say you can't copyright a chord change I mean this:
Lets say I was to record a song, publicly release it and copyright it. Get my millions etc..
And lets say that said song has three bars that just include a few chord changes, nothing else, no vocals nothing.
You cannot legally steal this section of the song. Several copyrights exist on music. One is the physical copyright that encompasses the actual specific recording. This is generally owne by the studio that recorded it or the record company. Thus if my chord change was a repetitive C-G-D. You could go and record it yourself. No harm done. No copyright infringment, no lawsuit.
This is a simple example by which I hope to convey the fact that it's illegal to steal anything from someone elses recorded music.
Then there is intellectual copyright. Which refers to the actual music itself, not the recording. It's usually owned by th publishing company. I won't go into this as I think it's fairly self-evident.

Does anyone know how Robert Rodriguez hooks his guitar to his computer for such an awesome sound? Is it simply through the little Line In plug?
Is it simply through the little Line In plug?
Simple answer: No, it isn't.
He has a Pro Tools HD system. My guess: his setup consists of the PCI Hd card, the digital converter (either the 96io or the 192io). He then has a preamp or DI box connected to the converter. This signal is then run through an amp simulator.
Personally I prefer the sound of an actual amp mic'ed up. Once it's a good amp of course.
Guitars have a very high impedance output and are unsuitable to connect to your computers line in. Hence the reason you need a preamp: to boost the level and adjust the impedance to low level line impedance.
This guy's setup is extremely expensive. But of course there is a lot less expensive equipment out there that can provide you with a similar setup.
For example, you could get a cheap digital converter that has onboard preamps and a DI (the DI is 'direct injection' which basically means you can hook your guitar straight into it). The converter might even come with a free amp simulator and recording software.

11-14-2008, 07:31 PM
Great. Thanks. What kind of microphone should I use?
Well what does the rest of your recording setup consist of? Do you have a preamp for the mic and an interface to hook it up to the computer?
Also are you recording electric or acoustic guitar?(I presume it's electric)
For electric: Dynamic mics are "usually" the best. One of the most notable being the Shure SM57.
For acoustic guitars I'd use large or small diapraghm condensers.
This is just to give you a basic idea. I've used different setups before. It all depends on the instrument and what kind of sound you want.
And remember you might actually get a great sound with an amp sim as opposed to recording. I usually only use amp sims if I am just recording ideas otherwise I'll mic up my amp.
Research it and find out what is right for you. Certain real guitar amplifiers will be out-performed by an amp simulator.

if you just want to record guitar a good place to start is by looking at Line 6's Toneport range. This comes bundled with Line 6's gearbox software for free and which you can upgrade along the line if you feel like it. It also comes with ableton live for recording software but its not too good, however it works.
The Presonus audio box and firebox are pretty good too but dont come bundled with any amp simulations. However, they come with Cubase LE which is much better than ableton.
Are you on a mac or PC?

PC. I’m using Magix Music Maker 7 [$20] currently.
Madison 2x half stacks [4 speakers each], 500 WAT Randoll head, Line 6 POD xt live effects pedal, electric and acoustic respectively.
My only microphone is something cheap from K-Mart. Which I plug straight into the computer. Should I run the microphone through a preamp before the computer?
I also want to record piano [not keyboard]. Is there anything I can record into, then transfer to computer?
Well how good is your guitar sound at the moment(just through the amp and with or without effects pedals)? Are you looking to record the sound you already have or improve on the sound in the recording?
I'm not a big fan of the standard onboard soundcards that computers come with. I could suggest you get an external soundcard that hooks up to your comuter via usb or firewire. Such interfaces usually come with mic preamps and DI ins. The previously mentioned Line 6 guys have some great stuff which usually come with amp sims too.
But such an interface might be too expensive for you so you could probably go with something cheaper (though bear in mind that you generally do get what you're paying for).
There are cheap usb connectors for mics now. The hook right up to the mics xlr socket. This will probably give you a better digital converter than your computer has but it might not. Cheap though, but perhaps unnecessary unless you've a good mic.
You'll need some form off external recorder to record the piano, unless you have a laptop or are willing and able to haul a desktop to the piano and record that way. There are a lot of such recorders out there, to be honest if you invested in a good one it'd also be good for recording your guitars too. The Zoom H2 is good. There's a lot of them so have a look around.
Or if you have a camera with a good onboard mic then use it to record the piano. Just extract the audio later.

New Question.
What if i want to refrence a famous song but not use it.
example-Rick astleys never gonna give you up as a joke
that brings up a question in me... is it against the law to use a song from a cd or a movie in your films?
its against the law, if you don't get the copyright holders permission, and you will also have to probably have pay royalities.
and remember to check the licensing on the these sites, as alot them require a fee for use in films etc.
you're best bet is go to local clubs etc and talk to the bands that play, or talk to local music groups, advertise on classifieds. or check out online groups like this one wes setup

If you play an instrument, I would highly recommend any sort of computer based software / hardware from Line6. I got their "Rifftracker" set, which came with Guitarport and a very simple recording software which I can run off my laptop with ease. You just plug a guitar into the Guitarport, the Guitarport into a free USB slot, and some speakers or headphones into the Guitarport.
Start up the software, and you've got all sorts of guitar sounds which you can use easily. You can also use the Microphone, Bass or Keyboard pre-sets to use these instruments, and it comes with some decent sound drum backing tracks.
I've used this this in a number of productions, and recorded a number of songs (You can here some comedy covers I've produced here (http://www.myspace.com/fatwalletmusic).
I'd recommend to anyone getting themselves a cheap keyboard as well - I spent £40 on a Yahama PSR-270 and, while it sounds a little cheesy, I can figure out some basic sounds that would work well.

I have it and i don't find one bad thing about it.

We either do three things
-If you can or you have friends ask them to make the music for you
-Download royalty free music(link that Sandman gave)
-Or pay the royalty to use it in your film(this will cost a lot of money)

I'm a freelance composer in Los Angeles and I currently license some of my original compositions to all levels of filmmakers. Sometimes for free.
If you're interested, you can check out some of my work on YouTube and my site. If you want, I could even do an original score for you, but I do charge for original scores/sessions.
Check out my Original Tracks on YouTube (http://www.youtube.com/view_play_list?p=27703C038FBA85D3).

Music with Creative Commons Licenses are a good way to go. www.Jamendo.com (http://www.Jamendo.com) is a site dedicated to CC Music. As long as you follow the set rules by the artists then you are aloud to use their music.

hey would any of you guys be able to recommend the easiest software to use in regards to composing quality music and or sound effects.
The other thing is how much musical knowledge would i need, if any. My knowledge is ridiculously basic and my only musical experience is playing guitar, but even then i cheat and use tabs xD.
What program to do recommend will suit?
Thanks in advance :)

Hello, I am interested in designing the score to your short film. I have worked on a short film in the past and am looking to beef up my portfolio. Looking to work in Sci-Fi, horror, thriller genre. I may be willing to do this for free if the film will compliment my work. Thanks, check out the music at:

Well here is a tip for all of you who want free music for your movies or footage. Certain items become under public domain when the copyright goes and it is free to use. If you still want to learn more about public domain stuff then I am pretty sure Mark Apsolon on youtube has an episode on this. Mark Apsolon is the user name so Look it up!

hey guys.
im interested in doing some original music for a short film. it would be an orchestral sort of thing, and of course i would do it completley free of charge (im not that evil!). i could do it for any genre and length of film however small or low budget, but preferably a relatively short one.
I use Sibelius 5 which is profesional musical scoring software; in fact, it was used to write the music in Quantum of Solace.
So if your interested just give me a bell.

I use royalty-free music from http://www.mediamusicnow.com/ - They have a good selection of scores for films and can be freely used on video sharing websites (e.g. YouTube, Vimeo).
The only problem I find with the music on this website is the price. Depending on the length of a song you buy, you could end up paying around £20 ($30) for one song.
I have also used some free music and loops from http://www.soundsnap.com/ but this site is mainly for sound effects and foley.
Hope this helps,
- Chris

Mixcraft by Acoustica (http://www.acoustica.com/mixcraft/) is an awesome software for those with limited musical skill, as well as the musically versed ... its cheap too ...

I'm not sure if any of this has been said, I didn't read the whole thread. but I mess around with these, for both score ideas, and actual sountracks.
Jamstudio.com
you can mess with it and save stuff for free, but to get the music you've made as an MP3 with you owning the rights to it, and alot more instruments to mess with, you have to pay for it, but I think it's worth it, as soon as I get the money I'm paying for it.
Hobox.com audio tool
it's ALOT more complicated, but I believe everything is free.

Personally i use istockphoto.com
It's a website that sells royalty free music for a buck or two for each track, but there are some pretty darn good tracks there.

Well personally I compose my own and record it. Though I am fortunate enough to have friends who play the required instruments and a good place to record. Though even if you just have a piano it is not to terrible hard to do because many programs well let you take an electric keyboard and record directly into the program.
