Legality Questions

For an upcoming short I would like too use two things.

1. some clips of resident evil 4

2. A shot of me playing the wii.

Can I use 13 seconds of resident evil 4 and give them credit under the fair use contract?
Also can I get in trouble for using a video game console?

Not sure about the Resident Evil thing, but the Wii part makes sense.

As long as you don't show the Wii name, you should be okay. I know that major motion pictures do that sometimes, with like a bottle of Coke, all you see is Co- or -oke. So you should be fine. And besides, unless you see this as becoming a huge hit, I wouldn't worry about it.

As long as you don't intend to release it as a DVD or something then you're okay AFAIK.

i would guess as long as u r not making money off it i can see u using the wii protion of it just keep the logo hidden... u might want to try to contact nintendo we did a new piece on video game systems and nintendo was actually willing to send us their own footage for free
